Unlawful Detainer
The Congress of Neutrals provides mediation services in unlawful detainer/eviction cases throughout Contra Costa County. Participation in these mediations, which are held on the day of trial in three of the local branch courts (Richmond, Pittsburg and Martinez), is free of charge, voluntary and confidential. An Agreement to Mediate must be reviewed and signed by all persons present during the settlement meeting.
There are several advantages to both the landlord and tenant to mediate these cases. We can negotiate payment plans, move-out dates, avoiding judgments (for tenants), while meeting the needs of the landlord.
The Judge/Commissioner supports and highly encourages mediation and will ask the parties to go mediate before the case can be heard. All mediated agreements in the Unlawful Detainer cases are signed by both parties and the Judicial Officer and are filed with the court for enforcement of the agreement, should it be necessary.

If the mediation is successful:
A written Mediated Settlement Agreement is prepared, reviewed and signed, and copies are given to each disputant
There is usually no need to go back into the courtroom if a settlement is reached
